Tanah Orang Asal Sarawak Terancam  
LAMBIR – Batu 1f Sungai Jaung terletak dalam kawasan DUN Lambir. Kebanyakan penduduk di situ berketurunan Malayu asal dari suku kaum Jati Miriek, Kadayan dan terdapat juga kaum Iban.  Tanah merupakan satu-satunya harta pusaka yang sangat berharga bagi kaum peribumi Sarawak.
Masalah utama yang dihadapi oleh penduduk asal peribumi Sarawak terutama bangsa Melayu dan Dayak adalah tanah mereka sekarang semakin terhakis akibat pembalakan dan perladangan dari syarikat swasta yang dikuasai oleh kroni pihak pemerintah.

Pihak kami telah menerima aduan dari salah seorang peneroka tanah temuda di kawasan Lambir yang mengatakan yang tanah mereka yang berjumlah ratusan hektar telah dicerobohi oleh syarikat perladangan yang menanam kelapa sawit di sekitar kawasan tanah temuda mereka.

Menurut salah seorang dari peneroka tanah tersebut yang dikenali sebagai Nordin Jukin memberitahu pihak kami yang tanah mereka sudah lama diterokai oleh datuk nenek moyang mereka puluhan tahun yang lalu semasa zaman penjajahan British tetapi sampai sekarang pihak kerajaan atau Jabatan Tanah dan Ukur tidak memberi hak milik tanah kepada penduduk asal tersebut.

Apabila mereka mengadu dan memohon hak milik dari pihak Jabatan Tanah dan Ukur langsung tidak memberi jawaban yang positif sebaliknya mereka terus menanti dengan penuh pengharapan agar tanah datuk nenek moyang mereka dulu tidak dirampas atau dimiliki oleh syarikat perladangan.

Tanah seluas 1236.03 ekar di Batu 1f Sungai Jaung jalan Miri Bintulu itu telah pun disukat dan dimiliki oleh seramai 83 orang penduduk tempatan di kawasan Lambir. Tanah mereka telah mula dicerobohi oleh sebuah syarikat perladangan yang menanam kelapa sawit dalam kawasan tersebut.

Mereka juga mengadu kepada pihak kami yang mereka sudah banyak kali mengadu masalah ini kepada pihak berkuasa, Jabatan Tanah dan Ukur, wakil rakyat, pihak polis serta pihak Suhakam tetapi masalah ini masih belum dapat diselesaikan. Mereka amat khuatir yang status tanah mereka yang telah diteroka oleh datuk nenek moyang mereka dulu akan hilang begitu saja dirampas oleh syarikat perladangan yang telah diberi peruntukan untuk memajak atau ‘Provision Lease (PL)’

Tanah yang dimiliki oleh penduduk asal sepatutnya diiktiraf oleh kerajaan dan Jabatan Tanah dan Ukur bukannya diberi kepada syarikat perladangan yang hanya mementingkan keuntungan semata-mata tanpa memikirkan akan nasib masa depan anak cucu penduduk asal yang tiada tempat untuk tinggal nanti sekiranya tanah mereka dirampas.

Mereka bertekad akan terus mempertahankan tanah hak milik mereka sekiranya pihak kerajaan tidak mempedulikan akan nasib mereka kerana mereka sudah bosan dengan janji-janji kosong pihak pemerintah untuk membantu mereka tetapi hakikatnya hanya mementingkan pihak syarikat dari rakyat sendiri.

Tanpa kebenaran pihak pemerintah sudah pasti pihak syarikat tidak berani menceroboh atau merampas tanah rakyat dengan sewenang-wenangnya. Mengapa pihak pemerintah lebih pentingkan pihak syarikat dari rakyat sendiri yang perlu tempat tinggal dan tempat untuk bertani.  Sepatutnya rakyat didahulukan bukannya dipinggirkan begitu saja tanpa sebarang pembelaan dari pihak berkuasa.

Kami mengesa pihak berkuasa terutama sekali pihak Jabatan Tanah dan Ukur Sarawak dapat menyelesaikan masalah tersebut dengan segera. Kerjasama dengan pihak yang berkenaan sangat dihargai dan kembalikan semula hak rakyat tanpa pilih kasih.

Public’s complaints “Sarawak indigenous land Endangered”

LAMBIR - Batu 1f Jaung River located in Lambir constituency. Most of the residents descended from the tribe of Malay origin Jati Miriek, Kadayan and there is also Iban. Land is the only valuable inheritance of the indigenous people of Sarawak.

The main problem faced by the indigenous natives of Sarawak, especially the Malay and Dayak is their land now is increasingly eroded due to logging and farming from the private companies that controlled by government cronies.

We have been received a complaint from one of the settlers temuda land in Lambir  that say that their land amounting to hundreds of hectares have been encroached by plantations that planting oil palm in their temuda land area.

According to one of the settlers, known as Nordin Jukin inform us which their land has long been explored by their forefathers decades ago during the British colonial period, but until now the government or the Department of Land and Survey did not give ownership of the land to the original inhabitants.

When their complained and apply for ownership from the Land and Survey Department did not give a positive answer instead they continue to look forward with great hope that the land of their forefathers did not confiscated or owned by plantation companies.

Land area of 1236.03 acres in the Batu 1f Jaung River Miri Bintulu road has been measured and is owned by a total of 83 local residents of Lambir. Their land has begun encroached on by a plantation company that plant oil palm in the area.

They also complained to us that they have many times complained this problem to the authorities, the Department of Lands and Survey, the elected representatives, the police and the Suhakam but this problem remains to be solved. They are very concerned with the status of their land that has been explored by their forefathers before will be just disappear confiscated by plantation companies that was given an allocation to lease or 'Provision Lease (PL)'.

Land owned by the original inhabitants should be recognized by the government and the Department of Lands and Survey, it should not given to plantation companies which pursue profits solely without considering the plight future of children and grandchildren of the original inhabitants which have no place to stay later if their land confiscated.

They are determined to continue to defend their land ownership if the government did not pay heed to their plight because they are tired of empty promises of the government to help them but the truth is only concerned with the company from its own people.

Without the permission of the government, the company certainly did not dare trespassing or seize the land of the people with impunity.  Why the government more concerned with the company from its own people which need a place to stay and a place to farm. Should people first rather than simply been marginalized without any support from the authorities.

We urge the authorities especially the Sarawak Land and Survey Department can solve the problem immediately. Cooperation with the parties concerned is very much appreciated and restores the rights of the people without favoritism.
