Penduduk tanah NCR hilang
keyakinan terhadap hakim
MIRI - Kes
tanah adat atau NCR kampung Haji Wahed mengambil masa bertahun-tahun untuk
diselesaikan menyebabkan penduduk kampung dan orang-orang yang menuntut hak tanah
nenek moyang mereka memutuskan bahawa hakim yang mengendalikan kes itu perlu
ditukar.
Alasan
mereka kerana peguam yang mereka lantik sukar untuk mengemukakan bahan bukti
yang mereka telah kemukakan. Setiap kali ada persidangan mahkamah hakim seolah-olah
lebih memihak kepada peguam bela pihak pemaju dan pihak jabatan tanah dan ukur.
Ini
menyebabkan mereka hilang keyakinan terhadap hakim yang mengendalikan kes tanah
tersebut dan akhirnya mereka mengumpulkan lebih dari seribu tandatangan petisyen
dari penduduk kampung yang hilang keyakinan terhadap hakim itu. Petisyen itu
telah diserahkan kepada pejabat Ketua Hakim Sabah dan Sarawak untuk tindakan
lanjut.
Esok Selasa
(07/03/2017) hakim yang mengendalikan kes tanah tersebut akan memberi keputusan
samaada untuk meneruskan atau memberi peluang kepada hakim lain untuk mendengar
kes tersebut.
Masalah
tanah yang dihadapi oleh penduduk Melayu dan penduduk asal Bumiputera Sarawak
memang sudah lama berlaku. Ramai yang mengadu masalah tanah mereka telah
diceroboh oleh pihak pemaju tanpa pengetahuan mereka. Mereka juga sudah banyak
kali menuntut hak tanah mereka agar pihak kerajaan memberi mereka geran tanah
tetapi sukar untuk mendapatkannya. Penduduk asal yang sudah lama menetap di
tanah datuk moyang mereka sebelum kedatangan penjajah British lagi sepatutnya
diberi keutamaan untuk mendapatkan gran tanah.
Kita
mengesa pihak kerajaan memberi perhatian serius terhadap isu yang dihadapi oleh
penduduk asal Sarawak ini dengan memberi keutamaan kepada mereka dari pemaju
kerana tanpa tanah maka sukar bagi mereka untuk bercucuk tanam dan membina
tempat tinggal.
Jangan
biarkan penduduk asal kehilangan tanah tempat mereka tinggal dan menjadikan
mereka setinggan dan menjadi pelarian di tanah air sendiri. Utamakan penduduk
asal dari orang yang hanya mementingkan keuntungan semata-mata.

The NCR land residents lose
confidence in the judge
MIRI - Indigenous
or NCR land cases of Haji Wahed village took many years to be resolved causes
the villagers and those who demand the right to their ancestral lands ruled
that the judge handling the case should be changed.
Their
reasons because lawyers that their appointed difficult to produce evidence that
they have been submitted. Whenever there is a trial court a judge of seems more
favorable to advocate of the developer and the land and survey department.
This
causes them to lose confidence in a judge of dealing with the case of the land
and finally they collected more than a thousand signatures on a petition from
residents who lose confidence in that judge. The petition was submitted to the
office of the Chief Judge of Sabah and Sarawak for further action.
Tomorrow,
Tuesday (07/03/2017), the judge handling the case of the land will decide
whether to continue or give the opportunity to another judge to hear the case.
A land
issue faced by the Malay and Bumiputera Sarawak natives has long been occurred.
Many who complain of their land had been encroached upon by the developer
without their knowledge. They also have plenty of time to claim their land
rights so that the government gave them the land grant but hard to get it. The
original inhabitants who had long lived in the land of their forefathers before
the arrival of the British colonists should be given priority for land grants.
We urge
the government to give serious attention to the issues faced by indigenous
people in Sarawak by giving priority to them from developers because without
land it is difficult for them to farm and build a shelter.
Do not
let the native’s loss of land where they live and making them squatters and become
refugees in their own land. Prioritize the original inhabitants of those who
pursue profits alone.
